Goals
BarGraders has adopted a privacy policy that attempts to meet the following goals:
- Provides users of the BarGraders Web site ("Users") with a safe, secure user experience. As used herein, the term "Users") includes both account-holders and subaccount-holders.
- Serves the purpose of a practice exam site, which is to provide a platform for taking practice exams and to have answers graded.
- Provides Users an understanding of what information is collected and distributed through their use of the BarGraders service, and to whom.
What Information is Collected
Aggregate User Information
In general, we gather aggregate information about Users. For example, we collect information about what areas Users visit most frequently and what services Users access the most. This information helps us determine what is working on our Web site and points us in the right direction in creating a Web site that better serves the needs of our Users. We do provide this information to third parties with whom we have a contractual arrangement, or with whom an obligation of confidentiality applies.
Specific User Information
When you register with BarGraders, we request that you provide certain information, like your name, law school, and e-mail address. If you register for BarGraders as a subaccount-holder, your specific user information will be provided to the account-holder of the primary account to which your subaccount belongs.
This specific user information is not provided to third parties, except to the extent referenced below:
- Surveys and Contests
When Users provide information in responding to a survey, we collect and publish certain information, such as how many people entered the given survey or contest, the results of the survey or contest, and rankings based on those results. We do not publish the identities, e-mail addresses, or any other personal information regarding Users entering the survey.
- Feedback
BarGraders has an area on the site where Users can submit feedback. Any feedback that is submitted through this area becomes the property of BarGraders. We may use this feedback, such as success stories, for marketing purposes, or to contact you for further feedback on the site.
- Transaction Processing and Business Functions.
We may share personal information with third-party vendors who assist us in performing internal functions necessary to operate our business, or who assist us in processing and completing transactions that you have requested. In the event that we use third-party vendors to assist us in performing these functions, the third parties may not use or disclose your personal information for any other purpose.
- Internal Analysis.
We may use information about you for our own internal purposes, such as to estimate our audience size, measure aggregate traffic patterns as well as to understand demographic, customer interest, and other trends among our users. We may outsource these tasks and disclose personal information about you to third parties in aggregate, provided the use and disclosure of your personal information by these third parties is restricted to performance of such tasks.
- Business Transfers.
Information about our users and the Service is one of our most important business assets. Therefore, information about our users, including personal information, will be disclosed as part of any merger or acquisition, creation of a separate business to provide the Service or fulfill products, sale or pledge of company assets as well as in the event of an insolvency, bankruptcy or receivership in which personal information would be transferred as one of the business assets of the company.
- Protection of BarGraders and Others.
We may release personal information in the good faith belief that release is appropriate and necessary to comply with legal process or authority (e.g., a lawful subpoena, warrant or court order); to enforce or apply our policies; to initiate, render, bill, and collect for amounts owed to us; to protect our rights, property, or personal safety of BarGraders, our users, our employees, or the public; or if we reasonably believe that an emergency involving immediate danger of death or serious physical injury to any person requires disclosure of communications or justifies disclosure of records without delay.
Cookies, Tracking
BarGraders uses cookies (small files that your Web browser places on your computer's hard drive) as a mechanism to retain and control the state of "being logged-in". Cookies also assist BarGraders to measure traffic (e.g., tracking repeat usage and estimating our user size). Most browsers automatically accept cookies as the default setting. You can modify the setting to reject cookies or to prompt you before accepting a cookie from the sites you visit by editing browser options.
No Information about Children.
Our Service is not intended to be used by children under the age of 13, and we do not knowingly, directly or passively, collect information from children under the age of 13. If we create offers and products that make it appropriate to collect information from children under the age of 13, we will notify you of the change in this Policy.
Future Changes to our Privacy Policy
We may in the future make changes to our Privacy Policy, particularly as we expand the services provided by BarGraders. If privacy is of concern to you, we recommend that you check back and review our Privacy Policy.
CALIFORNIA PRIVACY RIGHTS
California Civil Code Section 1798.83 permits customers who are California residents to request certain information regarding disclosure of personal information to third parties for their direct marketing purposes. We do not provide your personal information to any third party for their direct marketing purposes without your consent.
